WIRELESS INTERNET SERVICE AGREEMENT

1. Introduction

This is a binding agreement between the Customer ("Customer") and River City Wireless ("RCW"), located at P.O. Box 150, Newburgh, Indiana 47629-150, for wireless internet service ("Service").


RCW is committed to delivering reliable internet service while ensuring fair usage. Customers must use the Service lawfully and must not interfere with other customers' use. Use of RCW's service is subject to all applicable local, state, federal, and international laws.

2. Term of Agreement

This agreement begins upon service activation and continues until terminated by either party.

  • Customer Termination: Must be submitted in writing by the 27th of the month prior to cancellation.
  • RCW Termination: RCW may terminate service at any time with notice.
  • Price Lock: Monthly pricing is locked for the first 12 months.

3. Monthly Charges

A. Service Fees

Service charges are billed on the 1st of each month, due by the 10th.

B. Technology & Billing Fee

A $5.00 monthly fee covers:

  • Billing system maintenance
  • Secure payment processing
  • Network technology upgrades
  • Customer support systems

Waived if Customer is enrolled in AutoPay via ACH (checking or savings account).

4. Non-Recurring Charges

A. Basic Installation ($150)

Includes:

  • Site survey
  • Standard outdoor mounting (J-arm)
  • Up to 150 feet of Cat-5e cable
  • One wall penetration and cable routing
  • Power adapter installation
  • System testing

Payment Options:

  • $150 in full by install day
  • Or $50/month for 3 months

Non-refundable.

B. Exclusions

Does not include wall fishing, high ladder work, non-penetrating mounts, tree trimming, or networking multiple devices.

6. Equipment

  • RCW-owned equipment must be returned within 60 days of service termination.
  • Customer-owned equipment is the Customer's responsibility.
  • Service issues caused by third-party equipment remain billable.

7. Service Availability

Service may be impacted by:

  • Geographic and environmental factors
  • Government regulation or natural disasters
  • Equipment or network limitations

RCW makes no guarantees on uninterrupted service. Liability is limited to the service fee during outage periods.

8. Payments and Billing

  • Billing Date: 1st of each month
  • Due Date: 10th of each month
  • Late Fee: $15 after the 17th
  • Returned Check Fee: $25
  • Delinquency: Accounts 60+ days late may be deactivated. Equipment will be removed after 30 days of non-payment.

Forms of Payment:

  • Credit/Debit (Visa, MC, AmEx, Discover)
  • Check or Money Order

Cancellation:

  • Must be submitted before the 27th of the month.
  • AutoPay must be canceled separately.
  • Non-usage is not cancellation.

Refunds:

  • No refunds for installation or current/previous months.
  • Refunds may be issued for prepaid future months after cancellation.

9. Collection Costs

Customer agrees to cover collection costs, including attorney fees, if payment obligations are not met.

10. Access to Premises

Customer grants RCW access to premises for installation, maintenance, or removal of equipment. If the Customer is not the property owner, they must obtain permission.

11. Use of Service & Acceptable Use

  • Customers may not use the Service for unlawful, abusive, fraudulent, or excessive bandwidth usage.
  • Prohibited: Hacking, spamming, harassment, illegal downloads, copyright/trademark violations, obscenity, impersonation, and more.

12. Disclaimers & Limitation of Liability

  • Internet access is provided "AS IS" with no warranties.
  • RCW is not responsible for offensive internet content or damages resulting from service use.
  • If dissatisfied, the Customer’s sole remedy is cancellation.

13. Customer Responsibilities

Customers are responsible for:

  • Keeping account info updated
  • Protecting equipment and login credentials
  • Notifying RCW of billing issues within 30 days

14. Assignment

Customer rights under this agreement are not transferable.

15. Notices

16. Governing Law

This agreement is governed by the laws of the State of Indiana (or Customer’s state of residence). Disputes must be raised within one year.

17. Modifications

Changes to this agreement must be in writing and signed by both parties.

18. Warrick County Customers

RCW may share customer name, address, phone, and email with the Warrick County Economic Development Department as part of a public partnership.
